We (and third parties that provide content, advertising, or functionality on our Site) may use cookies and other technologies to facilitate Site administration and navigation, to better understand and improve our Site, to determine and improve the advertising shown to you here or elsewhere, and to provide you with a rich online experience. Cookies

A cookie is a tiny file that is stored on your device. It contains a unique identifier, as well as the address and other information about the site you are visiting. Other cookies collect information about how visitors use the Site (for instance, which pages visitors go to most often, and if they get error messages from web pages). When combined with information collected when you register on a website, cookies allow us to welcome you back to the site or otherwise provide enhanced, more personal features. Other tracking technologies

A variety of other tracking technologies, like web beacons, pixels, and tags, are also used. These are small strings of code that are placed on a web page, email, or advertisement. When you access a page containing one of these technologies, you establish a communication with a web server, which collects certain information about your computer or device. This information may include your IP address, browser type, operating system type, and identifiers that have been stored in cookies. We (and third parties) may use these technologies to count the number of visitors to our Site and to recognize users by accessing unique identifiers stored in cookies that we have set on their computers or devices. Being able to access these identifiers enables us to provide a personalized experience on our Site. For purposes of the balance of this "Cookie Policy," we will include all of these technologies within the generic term "cookies."

Categories of Cookies and your rights to opt out

As mentioned in the previous paragraphs, cookies are used for different purposes. Some cookies are "set" (delivered to your browser) by us. These are called "first party cookies." Others, called "third party cookies" are set by third parties who are given access to do so on our Site. We are proud to offer you multiple ways to make choices about accepting or rejecting some of these cookies The primary way to do this is by accessing the Cookie Settings that we have established for our Site (which you can access by clicking this link). Within the Cookie Settings, you will find descriptions of each category of cookie (similar to those immediately below), and then you will be able to choose to reject certain categories of cookies, should you wish to do so (except that you cannot choose to opt out of receiving cookies falling within the "strictly necessary" category, because our Site will not function properly without these).

Cookies on our Site fall into the following categories:

  • Strictly Necessary Cookies
    These cookies are necessary for the Site to function and cannot be switched off in our systems through the Cookie Settings. These cookies are usually only set in response to your request for services, such as setting your privacy preferences, logging in, filling in forms, and accessing secure areas of the Site. You can set your browser to block or alert you about these cookies, but some parts of the Site will not then work.
  • Analytics Cookies
    These cookies allow our Site to collect information about how you interact with the Site, including which pages you visit most often and if certain pages send you error messages. These cookies help us improve our services. If these cookies are blocked or disabled, our Site may become less functional, including the potential that some of our services may no longer be available to you.
  • Functional Cookies
    Functional cookies allow our Site to remember information, such as your preferred language, that can be used to customize your experience on our Site. These cookies also can be used to provide you with information specific to your region, and may assist you in customizing our Site’s appearance. If these cookies are blocked or disabled, our Site may become less functional, including the potential that some of our services may no longer be available to you.
  • Targeting Cookies
    Targeting cookies are used by parties that are involved in serving other companies' advertising on our Site, or that are involved in determining which of our advertisements (or other parties' advertisements) to show you on third-party websites. These cookies collect information about your online activities, such as the advertisements you have seen or the websites or pages you have visited, in order to draw inferences about what advertising might be relevant to you. This information is then used to show you targeted advertising (sometimes referred to as "interest based advertising" or "online behavioral advertising") that may be most relevant to you, including when you visit other websites not belonging to us. If these cookies are blocked or disabled, our Site may become less functional, including the potential that some of our services may no longer be available to you.

 

With respect to this final category of cookies described above (targeting cookies), we offer a second means of opting out of these cookies – beyond our Cookie Settings. The Cookie Settings relate to the cookies that are set on our Site, but does not affect the rest of the online world. There is also an industry-wide opt out program for targeting cookies that you can access by clicking here. Through this latter program, you can opt out of receiving targeting cookies from a broad array of third parties on any site, not just ours. Please be aware, though, that this opt-out process is itself cookie-based. In other words, if you opt out, a cookie is placed on your browser that informs these third parties that they are not to use cookies with you for targeted advertising. As a result, if you subsequently clear cookies from your browser (as many people do periodically), your opt out will be lost until you reinstate it.

California Residents:

Under California law, if you are a California resident and the processing of personal information about you is subject to the California Consumer Privacy Act (“CCPA”), you have certain rights with respect to that information. To exercise your options as described below, you may contact us in one of two ways: by telephone at (619) 855-3258 or by submitting a request to customerservice@bhufoods.com (collectively “Communication Methods”). To effectively exercise your privacy options, you must use one of these Communication Methods.

This list describes the types of requests you may make to us regarding information we have collected from you:

  • Request to Know: You may ask us to furnish you with (i) the categories and specific pieces of personal information we have collected about you; (ii) the categories of sources from which we collect information about you; (iii) the business or commercial purposes for collecting information about you; (iv) the categories of third parties with whom we share (or have shared in the prior 12 months) personal information about you, (v) for such third parties with whom we have disclosed personal information for a business purpose, the categories of personal information we have sold about you for such business purposes and (vi) for such third parties to whom we “sell” personal information, the categories of personal information sold about you.  The fact that you have the right to ask about information that is sold should not be implied to mean that we sell your information.
  • Request to Delete:You may ask us to delete any personal information about you that we have collected from you and to direct our service providers to delete your personal information from their records. After verifying your request, we will comply as further described below, subject to certain exceptions.
  • Self Service: If you are a registered user of our Site or applications, you may make changes to certain information, such as your contact information, by logging into your account on that website or application and navigating to your account or your profile within that website or application to update or correct your information directly in each website or application. Please note that not all of the information we have collected about you is available through your account or profile within our Site or applications.
  • Opt-Out of Sale:You have a right to opt-out from future “sales” personal information. Note that the CCPA defines “sell” and “personal information” very broadly, and some of our data sharing described in this privacy statement may be considered a “sale” under those definitions. In particular, we let advertising and analytics providers collect IP addresses, cookie IDs, and mobile IDs through our Site and applications when you use our online services, but do not “sell” any other types of personal information. To opt out from such “sales,” please follow the instructions in the “Do Not Sell My Info” disclosures in the Cookies and Other Technologies section of this statement. We do not knowingly sell the personal information of minors under 16 years of age without affirmative authorization.

We will make commercially reasonable efforts to accommodate your request within 45 days; however, we may notify you during the initial 45-day period that we will extend the timeframe by up to 45 additional days, if an extension is reasonably necessary in order to fulfill your request. We will fulfill the same request from you up to two times in any twelve-month period, but we are not able to fulfill redundant requests more frequently than that.

We will not discriminate against you because you have made a request described in this Privacy Statement or otherwise exercised your rights under applicable law. We may offer financial incentives or offer you a different price, level, or quality of goods or services in connection with programs that require you to disclose certain personal information, but only if you opt in to such an incentive program. If you opt in to any such incentive program, you may revoke your consent to share your personal information at any time, as described in the terms and conditions of those programs.

In addition, California law permits customers who are California residents to request certain information regarding our disclosure of personal information to third parties for the third parties’ own direct marketing purposes. To make such a request, please contact us using one of the Communication Methods described in this Privacy Statement, describing your request specifically.

IDENTITY VERIFICATION

To prevent fraud and other harmful activities, we may take reasonable measures to verify the identity of the person submitting any of the above requests (other than a request to Opt-Out of Sale). Initially, we will ask you to provide identifying information when you submit a request through a Communication Method. Providing accurate information that matches our records will help us identify the correct information. In the second step of verification, we may ask you to submit evidence proving your identity, which could include government issued IDs, signed statements, etc. The evidence we may request from you, and the degree of certainty we will be required to reach regarding your identity and the authenticity of your request, will depend upon the nature of your request, the nature of the information we have about you, and your ability to furnish information. If we ask you to verify your identity, you must promptly cooperate with our efforts so that we can fulfill your request. If you do not comply, your request cannot be fulfilled; and if you delay in complying, the fulfillment of your request is likely to be delayed as a result. Any additional information collected from you for verification will be deleted once the purpose for the verification has been satisfied.

AUTHORIZED AGENTS

If you submit a consumer privacy request on behalf of another person, you will be required to demonstrate your legal authority to act on behalf of that person, and we may contact you for verification purposes. For the protection of our customers, you must furnish all information requested and must demonstrate your authority to our satisfaction before we can fulfill your request.

SECURITY OF PERSONAL INFORMATION

We take reasonable and appropriate steps to help protect personal data from unauthorized access, use, disclosure, alteration, and destruction. Please be aware, though, that despite our efforts, no measures to safeguard data are perfect, and we cannot guarantee complete security.

To help us protect personal data if you set up an account with us, we request that you use a strong password and never share your password with anyone or use the same password with other sites or accounts.

PRIVACY STATEMENT MODIFICATIONS.

From time to time we may modify or amend this Privacy Statement in order to comply with new laws or regulations or to reflect future changes in our business practices. If we make any changes to this Privacy Statement, we will change the "Last Modified" date above or provide such notice about or obtain consent to changes as may be required by applicable law.
