This Privacy Policy describes how your personal information is collected, used, and shared by Laura’s Original Boston Brownies, Inc. dba Bhu Foods (“Bhu Foods”) when you visit or make a purchase from Bhufoods.com (the “Site”).

Personal information We Collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

We collect Device Information using the following technologies:

How do we use your personal information?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

  • Screen our orders for potential risk or fraud; and
  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services. This includes opting into our email lists to receive updates on our products as well as informational newsletters such as keto diet recipes. For example, if you add one of our products to your profile cart, a third party may serve retargeting adds based on the product you placed in your cart.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Public posting and social sharing

Social media logins and other integrations

When you log into your customer account using your social media account credentials, or use other social media services with us, your personal information will be disclosed to the social media account provider in connection with your login. By doing so, you authorize us to facilitate this sharing of information, and you understand that this sharing is governed by the social media site’s privacy policy that you used to log into your account.

Bhu Foods’ service providers

Bhu Foods uses third parties to provide services to you or us. This includes managing customer information; fulfilling promotions; sending marketing communications; conducting surveys; hosting websites; analyzing data; processing payments; fulfilling and shipping orders; or providing network security, accounting, auditing, and other services. We do not authorize these service providers to use or disclose your information for purposes other than why we have retained them.

Third party partners

We may share information with other companies when we work with them to promote our products, services, offers, contests, or other promotions to our customers.

Script or Loyalty Programs

If you participate in third party script, loyalty, or similar programs that Bhu Foods also participates in, we will share your information with them to facilitate the program. This may include sending your purchase information to credit card processors, so part of your purchase may be donated to participating schools or other non-profit organizations. If you participate in loyalty programs, we may send your information to the vendor administering the program. This information may include your name, email, credit card number, your purchase history, and other information you have provided to us through the program.

Once your information is provided to the third party it will be handled in accordance with their privacy policy. You should review the privacy policy before entering into a rewards, loyalty, or scrip program, so that you have a complete understanding of how your information is being used.

Payment card issuers

In certain countries, we may provide you with the opportunity to apply for an offer of credit from a payment card issuer. To create a more convenient application process, we may provide information from your customer account to a payment card issuer in order to generate a pre-approved credit offer or pre-populate your online credit card application with information from your customer account. By submitting a credit card application either in store or online, you acknowledge and agree that Bhu Foods may provide your information to the payment card issuer in accordance with the terms and conditions of the application. We may share information about you if necessary or appropriate, in our good faith judgment, to comply with laws or regulations, or in response to a valid subpoena, order, or government request, or to protect the operations, privacy, safety, property or rights of Bhu Foods.

During a sale or business transaction

In the event of any potential or actual reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings), your personal information may be shared with third parties such as the acquiring entity and its advisors.

Mobile Terms of Service

The Bhu Foods mobile message service (the "Service") is operated by Bhu Foods (“Bhu Foods”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Bhu Foods’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Bhu Foods through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Bhu Foods. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18665143755 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Bhu Foods mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Your California Privacy Rights

California Civil Code Section 1798.83 permits customers of Bhu Foods who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Please note that not all information sharing is covered by the “Shine the Light” requirements and only information on covered sharing will be included in our response. Data retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Minors

The Site is not intended for individuals under the age of 13.

We (and third parties that provide content, advertising, or functionality on our Site) may use cookies and other technologies to facilitate Site administration and navigation, to better understand and improve our Site, to determine and improve the advertising shown to you here or elsewhere, and to provide you with a rich online experience.   • Request to Know:You may ask us to furnish you with (i) the categories and specific pieces of personal information we have collected about you; (ii) the categories of sources from which we collect information about you; (iii) the business or commercial purposes for collecting information about you; (iv) the categories of third parties with whom we share (or have shared in the prior 12 months) personal information about you, (v) for such third parties with whom we have disclosed personal information for a business purpose, the categories of personal information we have sold about you for such business purposes and (vi) for such third parties to whom we “sell” personal information, the categories of personal information sold about you. The fact that you have the right to ask about information that is sold should not be implied to mean that we sell your information.
  • Request to Delete:You may ask us to delete any personal information about you that we have collected from you and to direct our service providers to delete your personal information from their records. IDENTITY VERIFICATION

To prevent fraud and other harmful activities, we may take reasonable measures to verify the identity of the person submitting any of the above requests (other than a request to Opt-Out of Sale). Initially, we will ask you to provide identifying information when you submit a request through a Communication Method. Providing accurate information that matches our records will help us identify the correct information. In the second step of verification, we may ask you to submit evidence proving your identity, which could include government issued IDs, signed statements, etc. The evidence we may request from you, and the degree of certainty we will be required to reach regarding your identity and the authenticity of your request, will depend upon the nature of your request, the nature of the information we have about you, and your ability to furnish information. If you submit a consumer privacy request on behalf of another person, you will be required to demonstrate your legal authority to act on behalf of that person, and we may contact you for verification purposes. For the protection of our customers, you must furnish all information requested and must demonstrate your authority to our satisfaction before we can fulfill your request.

SECURITY OF PERSONAL INFORMATION

We take reasonable and appropriate steps to help protect personal data from unauthorized access, use, disclosure, alteration, and destruction. Please be aware, though, that despite our efforts, no measures to safeguard data are perfect, and we cannot guarantee complete security.
